Property Management Potsdam
Property management for Potsdam and the surrounding area.
Residential and commercial property management for residential and commercial buildings in the state capital and the surrounding area in Brandenburg, for buildings and portfolios from 20 units or 500 m² of commercial space.
Managing in Potsdam means applying Brandenburg law.
Potsdam is the state capital of Brandenburg. For the rent cap, the increase cap and heritage protection, Brandenburg ordinances and laws apply here, not Berlin’s. Anyone holding property in both states needs a manager who knows both sets of rules.
The palaces and parks of Potsdam and Berlin were inscribed on the UNESCO World Heritage List in 1990 and extended in 1992 and 1999. The cityscape is shaped accordingly by historic building stock. For owners this means that for many buildings, heritage questions have to be clarified before repairs, facade work, window replacement or a loft conversion. Under the Brandenburg Heritage Protection Act (Brandenburgisches Denkmalschutzgesetz, BbgDSchG), those entitled to dispose of a monument must preserve it as far as can reasonably be expected (§ 7 BbgDSchG), and changes to a monument or in its surroundings require a permit (§ 9 BbgDSchG). For necessary construction work on a listed building, increased depreciation under § 7i EStG is possible; the certificate for this is issued by the heritage authority (§ 22 Abs. 2 BbgDSchG).
Tenancy law, too, has its own basis in Potsdam. On 03.12.2025 the state government issued a rent cap ordinance (Mietpreisbegrenzungsverordnung) and an ordinance on the increase cap (Kappungsgrenzenverordnung). Both name the state capital Potsdam. The rent cap (Mietpreisbremse) therefore applies from 01.01.2026 to 31.12.2029, the lowered increase cap of 15 percent from 01.01.2026 to 31.12.2030. The benchmark for the local reference rent is the rent index (Mietspiegel) of the state capital, which the city states it adjusts to market developments every two years in accordance with § 558d BGB; the current one is the 2026 rent index.
Besides Potsdam, both ordinances cover further municipalities around Berlin, such as Kleinmachnow, Stahnsdorf, Teltow, Werder (Havel) and Nuthetal in the district of Potsdam-Mittelmark. We look after holdings in Potsdam from our Berlin office and come on site for inspections, handovers and appointments with contractors.

Does the rent cap apply in Potsdam?
Yes. The Brandenburg rent cap ordinance (Mietpreisbegrenzungsverordnung) of 03.12.2025 names the state capital Potsdam as a municipality with a tight housing market. It applies from 01.01.2026 to 31.12.2029. For new lettings the rent may, as a rule, exceed the local reference rent by no more than 10 percent (§ 556d BGB). Details in our German-language article Mietpreisbremse.
Which cap applies to rent increases in Potsdam?
Under the Brandenburg ordinance on the increase cap (Kappungsgrenzenverordnung) of 03.12.2025, rents in Potsdam may rise by no more than 15 percent within three years when increased up to the local reference rent. The ordinance applies from 01.01.2026 to 31.12.2030.
